
When Luton Borough Council refused planning permission for a two-storey side and rear extension, our client, found himself at a crossroads. The Council claimed the development was oversized, visually discordant, and out of character with the surrounding area.

The appeal was submitted to the Planning Inspectorate a. A site visit was conducted on the 24th of February, and a decision was issued on the 19th of March. In a positive outcome, the Planning Inspector found in favour of our client and allowed the appeal, granting full planning permission for the proposed extension.
The Inspector noted that while the extension would certainly increase the size of the home, its design showed clear evidence of subordination. The lower roofline and set-back front wall demonstrated an effort to respect the character of the original house. Crucially, the Inspector concluded that the extension complemented the existing building and would not overwhelm it.
Another key point in the decision was the proposal to remove an existing outbuilding to create two off-street parking spaces. This was seen as a positive contribution that would help maintain a sense of openness at the rear of the property—something the Council had suggested would be lost.
Furthermore, the Inspector observed that several nearby corner properties had already been extended in a similar manner, reinforcing the idea that the proposal was in keeping with the established local character.
The Inspector concluded that the proposal would not cause unacceptable harm to the appearance of the house or surrounding area.
The Inspector also rejected a suggested condition from the Council that sought to limit the property to single-family use, finding it unreasonable, due to a lack of justification.
Planning conditions were applied to ensure the extension would use matching materials, provide parking prior to occupation, and avoid overlooking of neighbouring properties through first-floor side windows.
A condition was also imposed requiring any bin storage at the front of the property to be placed in a formal storage area to maintain visual quality.
