Garage Conversion to Dwelling LDC Appeal Overturns Refusal Use Class C3 Four‑Year Rule Proven

The original application was refused by BCP Council on 19 December because the Council said there was insufficient evidence that the garage had been occupied continuously as an independent self‑contained dwelling for more than four years, meaning it could not be immune from planning enforcement.

The appeal was allowed and a lawful development certificate was granted, confirming that the garage is a lawful self‑contained dwelling under Use Class C3.
