The original planning application was refused by Three Rivers District Council in March. The council argued that the proposed dwelling would be too close to neighbouring properties, resulting in an overbearing and visually intrusive impact. They also claimed the development would harm the character and appearance of the Conservation Area, describing it as a cramped form of backland development that would detract from the green and open setting of the area.

In the appeal decision, the Inspector confirmed that the proposed dwelling would not appear cramped or out of character. It was noted that similar forms of backland development already exist in the area and contribute to its established character. The Inspector found the design to be modest and appropriate, with the siting and existing landscaping ensuring that the development would be well screened from public views.
Concerns relating to neighbour amenity were also dismissed. The Inspector confirmed that separation distances between the proposed dwelling and neighbouring properties were more than adequate. There would be no unacceptable loss of light, outlook, or privacy, and the proposal would not result in the overbearing impact claimed by the council.
Crucially, the Inspector concluded that the development would preserve the character and appearance of the Conservation Area, fully complying with statutory heritage duties and relevant planning policy. With no conflict identified with either local or national planning policies, the appeal was allowed in full and planning permission was granted.
This case study demonstrates that planning refusals, even those citing sensitive issues such as Conservation Areas, neighbour impact, and character harm, are not final. When refusal reasons are subjective or poorly substantiated, a professionally prepared planning appeal can successfully overturn the decision.
