
Replacement of Existing Outbuilding to New Dwelling Planning Appeal Gwynedd Council

The proposal involved replacing an existing timber outbuilding with a single-storey, two-bedroom lodge providing accommodation for an older family member. The aim was to provide greater independence while allowing her to remain close to relatives who could provide ongoing care and support.
Gwynedd Council refused planning permission on 30 May.
The Council considered the proposed annexe unnecessary development within the open countryside and raised concerns that it could effectively operate as a separate independent dwelling.
Officers highlighted its separation from the main house, the facilities provided for independent living and the possibility of adapting the existing property instead.
Importantly, however, the officer’s report accepted that the development would cause no unacceptable harm to local character, neighbouring properties or residential amenity.
The central issue was therefore whether the lodge represented a genuine residential annexe or potentially a new dwelling.
Our appeal addressed this distinction directly.
We demonstrated that the proposal was care-led family accommodation rather than a speculative new dwelling.
The lodge would replace a long-standing outbuilding on substantially the same footprint and remain connected to the existing home through its family use, shared access, parking, services and wider domestic setting.
The proposal also reused previously developed land, responded to a genuine family need and would not create new residential sprawl within the countryside.
Crucially, the appellant offered to accept a planning condition preventing the lodge from being sold, let or occupied separately from the main property, directly addressing the Council’s principal concern.
Following a site visit on 23 October, the Planning Inspector allowed the appeal on 10 November and granted planning permission.
The Inspector found that there was no proposal for a separate dwelling before them.
Access and parking would be shared with the main property, there would be no separate garden, and the modest single-storey lodge would remain significantly smaller than and close to the main house.
The family relationship and care arrangements also meant that the occupants could reasonably be regarded as forming one household.
Importantly, the Inspector found there was no legal or planning policy requirement for the family to adapt the main house instead.
The annexe could therefore be considered “part and parcel” of the main family home, with any potential future risk of independent occupation controlled through a planning condition.
Planning permission was granted subject to four conditions covering commencement, approved plans, biodiversity enhancements and a restriction requiring the lodge to remain part of the family home.
There were approximately five and a half months between the original refusal and the successful appeal decision.
This case demonstrates why a planning refusal does not necessarily have to be the end of the road.
While the Council considered the proposal capable of becoming a separate dwelling, the appeal successfully demonstrated that it represented a modest and controlled family annexe with genuine functional and family connections to the main home.
