Planning Appeal Success Two-Storey Rear Extension Approved in East Sussex

We recently secured a planning appeal win for a two-storey rear extension and associated alterations in East Sussex, after Rother District Council refused the original application.

The refusal, issued on July 26th, claimed the proposed extension would be overbearing and dominate views from a neighbouring property—particularly from a bedroom window overlooking the site. The Council stated that the massing and design would create a sense of enclosure and negatively affect residential amenity.

The Outcome

In the Inspector’s analysis:

The neighbouring homes—Orchard Cottage and Meadow View—were noted as staggered semi-detached properties, which influenced sightlines and impact.

The part of the extension closest to the boundary projected only modestly, reducing its potential to overbear or dominate.

The design was considered appropriate, and while the extension would be visible from the garden and patio, it would not create an unacceptable sense of enclosure.

The north-facing orientation meant the neighbouring property would not suffer substantial loss of light, and the bedroom window’s outlook remained largely unaffected.

The Inspector concluded that the proposal complied with relevant local and national planning policies, and therefore, the refusal should be overturned.
