In November our client received a planning permission refusal from London Borough of Richmond upon Thames Council for their recent planning application. The application was for the demolition of an existing garage and ancillary outbuildings on garden land and the construction of 2 new detached houses.
The application was refused for the following reason;
1. The proposed development, by reason of its poor layout and excessive site coverage by buildings and hard-surfaced access road and parking, would give rise to a loss of open green space and the creation of a feature which is out-of-keeping with this rear garden setting and alien to the character of this street of older tight-knit housing within the Wick Road Conservation Area and detrimental to the amenities afforded to existing occupants of surrounding residential properties and future occupants of the development proposed. The proposal is therefore contrary to Policies LP1, LP3 and LP8 of the adopted Local Plan (2018) and Supplementary Planning Documents: Design Quality and Small and Medium Housing Sites.
The provision of two dwellings here would provide a symmetry to the street as the opposite side of the road had dwellings right up to the boundary. The proposed dwellings had been designed to be in-keeping with the existing properties and would therefore not stand out as incongruous in the street scene. There would be no negative impacts on neighbouring properties resulting from this proposal.
The client had worked proactively with the Council and had come up with a design solution that was mutually acceptable and appropriate for the site. The design had been confirmed as being acceptable and of a nature that would complement and enhance the character and appearance of the Conservation Area. There were no detrimental impacts upon neighbouring amenities resulting from the proposal and it had been considered as acceptable on sustainability and highways grounds.
The Council was unable to demonstrate a five-year deliverable housing land supply and therefore a presumption in favour of sustainable development should have been taken here
under the policies of the NPPF 2021. The Planning Officer was clearly supportive of the proposal and there were no adverse impacts that would outweigh the benefits of this proposal. It was clear that the committee had no good reason to override the Planning Officer’s recommendation as the proposal clearly complied with all the relevant local and national planning policies that it has been measured against.
We submitted a 36-page appeal statement to the planning inspector and a site visit was made to the property on October 19th and a decision was received on November 10th.
