We recently secured a retrospective planning appeal success for a commercial business in the Shropshire countryside, overturning a refusal issued by Shropshire Council.
The proposal involved a change of use of a small parcel of land—including remnants of a former RAF airfield—to allow for a dog exercise area and the erection of a modest timber building to operate as an indoor daycare facility.
Despite the partial use of the site and its history, the Council refused planning permission on 21st December, claiming:
The site was in open countryside and considered an unsustainable location.
The proposed development did not maintain or enhance the rural character or vitality.
The timber building was out of keeping with its countryside setting.

The Outcome
A site visit was conducted by the Planning Inspectorate on 5th March, and on 12th April, the Inspector allowed the appeal and granted full retrospective planning permission.
Key findings from the Inspector’s decision included:
The proposal aligned with Policy CS5 by supporting rural economic diversification and employment. The fact that the business was relocating, rather than starting anew, did not limit its policy compliance.
The Inspector recognised that dog daycare services are more appropriately located in rural settings due to their nature and potential impact in residential areas.
Traffic concerns were addressed through a condition requiring dogs to be collected and dropped off by staff, not customers—significantly reducing vehicle movements and making the proposal sustainable in transport terms.
The modest timber building and fencing were not visually intrusive, especially given existing hedgerow screening and tree cover. Though non-agricultural in design, the building was found to be sympathetic to its surroundings.
Importantly, the site was considered previously developed land, due to visible remnants of RAF infrastructure—strengthening the planning case under both local and national policy.
Result: Appeal Allowed. Planning Permission Granted.
The dog daycare business can now continue operating and growing in its new rural home—thanks to careful appeal strategy, expert planning advice, and a well-argued case.
