New Dwelling Planning Appeal Win Bromley Council


The application was originally refused by Bromley Council on the 25th of September. The key issue raised by the Council was that the development had not demonstrated suitable access for construction vehicles, emergency services, or future residents.

They also raised concerns about the turning space and on-site parking provision. The Council argued that the proposal was contrary to a number of policies from both the London Plan and the Bromley Local Plan, including policies related to transport, safety, parking, and site design.

A site visit was carried out by the Planning Inspectorate on the 23rd of April, and the final decision was issued on the 9th of July. In an important turn of events, Bromley Council notified the Inspectorate that they no longer wished to defend their refusal. They accepted that the benefits of the proposed development outweighed any potential harm and suggested a list of planning conditions that could be applied if the appeal was allowed.

Despite the Council withdrawing their objection, the Planning Inspector still needed to review the case in full and decide whether there were any remaining issues that could justify dismissing the appeal. The Inspector examined the proposal carefully and found that the site, which included garden space and a lower-level garage, was suitable for development. It was accepted that the site’s constraints, such as the steep slope and tight footprint, could be managed through thoughtful design and planning conditions.

Concerns about construction access and the stability of the retaining wall were acknowledged, but the Inspector agreed that these could be resolved through a detailed Construction Management Plan, to be submitted before any work commenced.
The Inspector also noted that the development complied with relevant policies in both the London Plan and Bromley Local Plan relating to parking, highway safety, and fire safety.

A range of conditions were imposed to ensure the development met the necessary standards. These included requirements for drainage, landscaping, parking layout, electric vehicle charging, bicycle storage, and the use of permeable paving to control surface water. However, the Inspector rejected more restrictive conditions suggested by the Council, such as removing permitted development rights or requiring vehicle wheel-washing facilities, stating these were not reasonable or necessary for a small-scale development like this.

With all factors considered, the Planning Inspector allowed the appeal and granted full planning permission for the one-bedroom detached dwelling. This case highlights how a carefully prepared appeal can succeed even when a local authority initially refuses permission based on speculative or overly cautious reasoning.

It also demonstrates how small, well-located infill sites can contribute meaningfully to local housing supply.
