In February our client received a planning refusal from Gedling Council for a new detached double garage. After taking advantage of our free no obligation telephone consultation, they instructed us to appeal on their behalf.
The reason given by Gedling Council was;
1. It is considered, given the character of the area, the scale, location and design proposed, the proposed development would result in an incongruous feature in the street scene which would harm the visual amenity of the area. The proposal is contrary to the NPPF Section 12 and Policy 10 of the Aligned Core Strategy
After being instructed by our client their case moves to documentation collation and research into the area. We found that there was no harm to public amenity from this development as confirmed by the LPA in the Officer’s Report. The appeal site was not within, or visible from, the Green Belt, not within a Conservation Area, nor does it affect a Listed Building.
There were no site constraints to consider. It was within a settlement boundary where the principle of residential development was wholly acceptable. The surrounding built environment showed a distinct mix of housing types, from flats and new builds to traditional detached properties set within acres of land. There was a precedent in the area as detached garage buildings are a prominent and regular feature of the street scene and wider landscape. Some of the detached garages nearby were more prominent than others within their plots, and they varied in both their setback from the road and their size in proportion to the host dwellings. We included snap shots of these in the statement.
We submitted a 24 page appeal statement to the planning inspectorate, detailing our findings and arguing that the application was acceptable.
A site visit was made to the property on July 13th and we received their decision on July 28th.
We are pleased to announce that the appeal was successful and planning permission was granted.
