Planning Appeal Success Refused Garage Plans Approved in Rural Shropshire at Appeal

This case started the way many do—our client received a planning refusal from the local authority for a modest, well-designed garage. Despite the proposal’s low visual and environmental impact, Shropshire Council refused permission, citing multiple Core Strategy policies and a lack of justification for the need and scale of the building.

The council claimed:

The garage conflicted with Core Strategy policies around appropriate scale and design.

The proposal lay outside the domestic curtilage, and therefore required full planning permission—which they were unwilling to grant.

How HEAL Planning Helped
The client reached out and booked a free, no-obligation consultation with one of our planning appeal specialists. After carefully assessing the decision notice and context of the site, we advised that an appeal had strong merit. We provided a detailed written proposal, and the client chose to proceed.

The appeal was submitted to the Planning Inspectorate. After a site visit on March 13th, a decision was issued on April 24th.

The Outcome
The Inspector overturned the refusal and granted full planning permission for the garage.

Key highlights from the Inspector’s decision:

The property sits on approximately five acres, with an existing steel building already present. The new garage was smaller, and its impact was mitigated by mature trees and proposed hedgerow planting.

While the structure would be partially visible from a public footpath and passing trains, it would not cause material harm to the area’s character.

Concerns about the garage’s location outside the residential curtilage were noted—but deemed irrelevant to the central planning issues.

Conditions were attached to protect nearby trees and to restrict the garage’s use to storage associated with the main property.

Most importantly, the Inspector concluded that the garage respected the local character and fully complied with Core Strategy design principles.

The HEAL Planning Difference
This case is a perfect example of how expert appeal advice, a clear understanding of planning policy, and a carefully structured argument can successfully overturn a refusal.
