Driveway Across Amenity Land Approved at Planning Appeal Basildon Council


Today, we’re sharing a recent planning appeal success from HEAL Planning, where we helped our client overturn a refusal for a driveway application in the area of Basildon, Essex. This is a great example of how professional support can turn a setback into a success.

The original application was submitted to Basildon Borough Council. It proposed a new driveway and vehicular crossover to provide access across an open green area in front of the property.

But on June 3rd, the Council refused permission. They argued that introducing a driveway would visually damage the character of the neighbourhood, reduce the green amenity space, and disrupt the tranquillity of the area. Their position was clear: the hard surface would devalue the open space and negatively affect the surrounding environment.

That’s when the homeowner came to us for help.
The journey began with a free, no-obligation consultation with one of our specialist planning appeal assessment officers. We reviewed the refusal, assessed the context and policies, and confirmed there was a strong basis for appeal.

We then provided the client with a detailed written proposal, fully outlining their options and the potential for success.

Confident in our strategy, the client chose to proceed, and we submitted the appeal to the Planning Inspectorate. The Planning Inspector visited the site on February 18th and issued their decision on March 5th. The outcome was a full approval of the development.

The Inspector agreed with our position. While acknowledging that the amenity space was a valued feature, they pointed out that the proposed driveway would be constructed using concrete with a grass-through design.

This meant the area would still appear green and open, even if it was no longer used as a traditional amenity space.

Importantly, they noted that other properties in the same terrace already have driveways crossing similar green areas. Although the Council claimed those driveways didn’t have planning permission, the Inspector concluded that they still formed part of the area’s established character, meaning our client’s proposal wouldn’t look out of place or cause harm to the street scene.

The Inspector also dismissed the Council’s argument about the risk of setting a precedent. They stated that each application must be judged on its own merits, something we often argue in appeals like this.

In the end, the Inspector concluded that the proposal would not cause material harm to the character or appearance of the area.

Our client now has full planning permission for their driveway, and peace of mind that their investment in an appeal was worth it.
