In this video, John Peters from HEAL Planning shares another successful planning appeal case study, this time involving a Conservation Area in Torbay. Our client had faced a planning refusal from Torbay Council after applying to replace the existing door, windows, and roof on a single-storey porch extension.
The refusal, issued on 13th September 2024, claimed that the proposed external materials would fail to preserve or enhance the character and appearance of the surrounding Conservation Area and nearby Grade II listed buildings. Torbay Council considered the scheme contrary to the Torbay Local Plan and relevant local heritage policies.
After this setback, the homeowner contacted HEAL Planning for a free no-obligation consultation with one of our Planning Appeal Assessment Officers. During that consultation, we identified strong grounds to appeal. We then provided a detailed written proposal outlining the case strategy so that the client could make an informed decision before proceeding. Confident in our expertise, they instructed us to handle the appeal.
Our appeals team carefully prepared the submission and presented a robust case to the Planning Inspectorate, the government body that deals with planning appeals across England. The site visit took place on 17th April, and the Inspector’s final decision was issued on 18th August.
In their assessment, the Inspector agreed that heritage sensitivity was important given the Conservation Area location and the proximity to listed buildings. However, they also noted that the existing porch was in poor condition and detracted from the area’s character. This acknowledgment was a key factor in weighing the balance of the case.
The Inspector also recognised that while timber windows were historically the norm in this area, uPVC windows now dominate both the appeal property and many surrounding houses. As a result, the contribution of traditional timber frames to local character was considered limited. The Inspector found that high-quality timber-effect designs could achieve an appropriate heritage look, and this could be secured by way of a planning condition.
Additionally, the appeal design included a pitched roof that was more in keeping with surrounding properties. Taken together, the Inspector concluded that the proposed porch would have a neutral impact on both the Conservation Area and the setting of nearby listed buildings.
The appeal was therefore allowed, subject to planning conditions ensuring the final materials – including roof tiles, brickwork, and detailed window designs – would respect the historic context.
This successful outcome means our client can now move forward with much-needed home improvements, secure in the knowledge that the design both enhances their property and harmonises with its historic surroundings.
