In this case study, Managing Director John Peters explains how our team successfully challenged a planning refusal by Castle Point Borough Council. The case involved an upwards development proposal to create three new dwellings, which was originally refused on the basis of flood risk.
The Council had claimed that the existing building structure could not safely withstand the potential pressures caused by flooding, and therefore the scheme posed an unacceptable risk to future residents. However, after reviewing the refusal, our expert team identified strong technical grounds to appeal the decision.

Supporting evidence from structural and civil engineers confirmed that the existing building was capable of withstanding all predicted hydrodynamic pressures.
The Inspector concluded that the development was safe for its lifetime and therefore met the relevant national flood-risk policies. Additionally, the appeal addressed all wider planning matters. The development made a contribution to the Essex Coast mitigation strategy, ensuring no adverse effects on protected coastal habitats.
Further, it was found that the proposal would integrate well with the local area, offer adequate parking and waste provision, and protect the privacy and living conditions of neighbouring residents.
As a result, the appeal was allowed, and planning permission was granted for the creation of three new dwellings. This successful outcome overturned the Council’s decision and highlighted how strong technical evidence and professional appeal representation can overcome even complex environmental objections.
