In this planning appeal case study, John Peters from HEAL Planning shares another successful outcome for a client who had faced refusal from Calderdale Metropolitan Borough Council. The case involved a retrospective planning application for a garden room that had been refused on multiple grounds, including Green Belt policy, residential curtilage, and landscape character.

Calderdale Council had originally refused the application for three main reasons:
They claimed the garden room was partly outside the domestic curtilage and therefore could not be properly considered as a householder submission.
They argued that the property’s position within the Green Belt meant the development was inappropriate and harmful to openness, contrary to both local and national planning policy.
They stated that the garden room was overly dominant, failed to respect the character of the host dwelling, and harmed the qualities of the Special Landscape Area.
The Inspector visited the site on 20th June and issued their decision on 2nd September. After a careful review, the appeal was allowed and planning permission was granted.
Key findings from the decision included:
Residential curtilage: The Inspector dismissed the Council’s argument, confirming that the appeal could be considered in the standard way.
Green Belt: The Inspector concluded that the garden room was modest, clearly subservient to the main dwelling, and not a disproportionate addition. It therefore did not represent inappropriate development within the Green Belt.
Design and character: The Inspector praised the building’s quality. The use of natural stone tied it to the surrounding properties, the glazed frontage reduced its visual impact, and the siting into the hillside with landscaping provided natural screening. Together, these elements ensured the garden room respected the character of both the host property and the wider Special Landscape Area.
Planning permission was granted subject to reasonable conditions, including the retention of approved materials and ensuring the garden room remains ancillary to the main dwelling.
This appeal shows that even when Councils refuse permission on strong grounds such as Green Belt policy and landscape character, those decisions can be overturned with the right strategy, expertise, and a carefully argued case.
